References to ‘we’ or ‘our’ or ‘us’ in this policy means APEXFusion Pty. Ltd. ABN 73 607 472 122 and its related brands GreenPepper Invest (GPI), GreenPepper Capital (GPC), RedPepper Mergers (RPM) and SIM(pli).Today.

GreenPepper Invest is the brand name of our equity / funding platform connecting early-stage business and interested investors. It is important to note that these funding services are provided solely by the brand GreenPepper Invest and exclusively available through the GreenPepper Invest platform found at www.greenpepperinvest.com.

GreenPepper Invest is a wholly-owned brand of APEXFusion Pty. Ltd. ACN 607 472 122.

What is the purpose of this Privacy Policy?

This Privacy Policy explains how APEXFusion Pty Ltd and its brands, GreenPepper Invest (GPI), GreenPepper Capital (GPC) , RedPepper Mergers (RPM) and SIM(pli).Today collect, use and hold personal information of any nature.

This Privacy Policy applies to all websites that APEXFusion Pty Ltd, and the brands it owns and operates, that result in digital interactions and data storage.

Please read this Privacy Policy, in conjunction with our Registrant Terms and Conditions carefully, since by using any APEXFusion website, service or product, registrants expressly agree to the terms of both policies.

‘Personal information’ means information that can be used to personally identify you, like your name, email, address, telephone number, bank account details, support queries, discussion board comments and so on. Where this information is collected, this Privacy Policy applies.

  • conducting auditing and keeping records so as to comply with our legal and regulatory obligations

Any other purpose outside of this list will be consistent with those permitted under privacy or other applicable laws.

We use digital optimisation tools to track and monitor your use of our websites and services and by carrying out technical analysis, we can keep improving and developing services you want to use, we can also optimise your user experience and provide you with better services and a more efficient experience. This helps us to develop our services for you.

We may use personal information we collect to produce aggregated, de-identified analytics, information and reports, which we then use for research, analysis, benchmarking and development of our services. We may also share this information publicly, with third parties or for marketing or promotional purposes. This information is not personal information as it does not identify you or any other individual. How we collect and hold personal information

When you visit our websites or use our services, we DO collect some personal information such as:

Information you provide to us directly:

  • When you visit or use our websites or services we ask you to provide certain personal information to us. For example, we ask for information when you sign up for an account (we call this your GreenPepper Invest account), create or modify your profile, set your preferences or make an investment.
  • We also collect information when you respond to a job application, participate in discussion boards, join us on social media, take part in webinars and events, contact us with questions or request support.

Information we collect automatically:

  • We collect some information about you automatically when you visit our websites or use our services, like your IP address, browser and device type.
  • We also collect information when you navigate through our websites and services, including what pages you looked at and what links you clicked on. This information is useful for us as it helps us get a better understanding of how you’re using our websites and services so that we can continue to provide the best experience possible. Some of this information is collected using cookies and similar tracking technologies – we explain this more below.

Information we get from third parties:

  • We collect some information about you from other sources, such as publicly available databases and materials, third party data providers, social media platforms and from business partners.
  • We may combine this information with the other information we collect about you in order to better inform, personalise and improve our services and to validate the personal information you provide.

How we hold personal information

As a technology company and provider of online services, the information we collect is predominantly held in a digital format.
To protect this information we take reasonable steps, such as contractual, administrative and industry standard technical solutions to help protect against unauthorised access, disclosure or misuse. We also review our security procedures periodically to consider appropriate new technology and updated methods.

Finally, all our employees undertake training in handling information, with particular emphasis on protecting the personal information of individuals but we do also limit access to those that require such access.

Payment information is transmitted securely using Secure Sockets Layer (SSL) encryption technology and processed through our third-party partner’s secure payment gateway (which is PCI-DSS compliant). We do not store your payment information (such as bank account details, credit card or debit card information) on our websites’ servers or databases. You will see some of your bank account information in your profile, this is a masked version of the information which is necessary for the payment validation process.

How we share your personal information

  • other companies in the GreenPepper group of companies and our employees and shareholders
  • our clients in connection with providing our services to that client (e.g., if you express interest in investing in a company or invest in a company, we will provide your details to that company)
  • our and our client’s third party service providers and partners in connection with providing our services (e.g., if you make an investment in a company, we may provide your information to our payment processor or to the company’s share registry to manage your investment)
  • regulators, law enforcement bodies, government agencies, courts or other third parties where we think it’s necessary to comply with applicable laws or regulations, or to exercise, establish or defend our legal rights
  • an actual or potential buyer or investor (and its agents and advisors) in connection with an actual or proposed purchase, investment or acquisition of any part of our business
  • other people where we have your consent

How you share your personal information

In order to facilitate interaction among all community members and to comply with our legal obligations, our services allow you limited access to other users’ contact information (and them to yours). For example:

  • Throughout our websites, you may be identified by your full name (this is important, we’re a legally regulated service not an anonymous forum)
  • If you select your email address as your full name, you may disclose your email address to other users and third parties
  • Others may be able to see the companies that you have supported, comments you have made on the discussion boards and so on
  • If you submit an expression of interest or make an application to invest in a company, we allow the company and our employees to view your personal information, including your full name and email address
  • If you are a company, you will have access to the personal information, including full name and email address, of an investor (and an investor will have access to yours)
  • If you are an investor, you will have access to the personal information, including full name and email address, of the company and its directors and senior managers (and the company will have access to yours)

What happens if we can’t collect your personal information

If you don’t want to provide us with your personal information or we don’t collect your personal information, we may be unable to provide you with all our services and some functions and features on our websites may not be available to you.

How long do we keep your personal information

The length of time we keep your personal information (whether or not your GreenPepper Invest account is deactivated) depends on what it is and whether we have an ongoing business need to retain it (e.g., to provide our services or to comply with our legal, tax, accounting or other regulatory obligations).

We’ll retain your personal information for as long as we have a relationship with you and for a period of time afterwards where we have an ongoing business need to retain it. Following that period, we’ll take reasonable steps to delete or de-identify it. Just so you know, most of your personal information is or will be stored in our client files which will be kept by us for a minimum of 7 years.

If you would like us to do so, we will deactivate your GreenPepper Invest account on your request. After your GreenPepper Invest account is deactivated, it will be removed from our websites and you will no longer be able to login, however, we may retain your personal information as described above. To make a deactivation request, please send an email using the contact details below.

Disclosure of personal information outside Australia

Our business operates from Australia but we are a technology company and provide online services. In supplying our services, we may utilise service providers, resources and cloud based processes located outside of Australia (and so the information we collect from you may be transferred to and stored overseas). For example, we may disclose your personal information to the following persons located outside of Australia or who may store data outside of Australia:

  • our employees and contractors when working outside of Australia
  • our data hosting and cloud-based IT service providers
  • other external technology partners and service providers

What about direct marketing and privacy?

As part of our services, we have developed databases that are used by us to supply information regarding our services that may be of interest to individuals and businesses and also to our clients in connection with the services we offer (e.g., if you express interest in investing in a company, we will provide your details to that company). This database includes personal information that is obtained as described in this Privacy Policy.

We may send you direct marketing communications and information about services that we consider may be of interest to you. These communications may be sent in various forms, including SMS or email, in accordance with applicable laws.

If you do not wish to receive marketing information you may at any time unsubscribe from receiving such information by responding via the channel in which you received the marketing communication (e.g. an opt-out tool like Unsubscribe or you can set preferences in your GreenPepper Invest profile).

It is important to note that the opt-out request is limited to marketing material. We may still send you non-marketing information, such as information about your investments, important service updates or if we update this Privacy Policy or our Registrant Terms and Conditions

A company you follow, express an interest in or invest in, may also send you direct marketing communications and information. If you do not wish to receive marketing information from that company we encourage you to contact the company. As you can appreciate, we are not responsible for the activities of a third party.

External links and third parties

Our website may contain links to, and interfaces with, websites, services and widgets operated by third parties (such as social media sites and features (e.g. “likes” and “shares”), search engines, companies seeking investment through our websites or other partners). Third parties are responsible for informing you about their own privacy practices so if you use these businesses, we encourage you to check out their privacy policies.

As you can appreciate, we make no representations or warranties in relation to the privacy practices of any third party website and we are not responsible for the privacy policies or the content of any third party website.

A note about passwords

You should keep your password confidential (like all your passwords). You are responsible for all actions taken with your password and we recommend that you do not give your password to anyone. If you choose to share your password or your information with a third party (e.g., to provide you additional services), you continue to be responsible for all actions taken with your password. Before you do, we recommend you check out that third party’s privacy policy.

If you lose control of your password, you may lose substantial control over your personal information and you may be subject to legally binding actions taken on your behalf. If you believe your password has been compromised for any reason, you should immediately change your password and confirm all transactions on your accounts.

Accessing and correcting your personal information

Once you have created a GreenPepper Invest account, you can review and change your personal information at any time, including your name, company, address, phone number, bank account details and your password. You must update your personal information as soon as you can after it changes.

We strive to make sure information about you is accurate when we collect or use it. In addition to you being able to access your GreenPepper Invest account, we will let you see the information we hold about you and correct it if it is inaccurate, incomplete or out-of-date, subject to some exceptions under privacy law. If we do not grant you access to your personal information or do not agree to correct your personal information we will tell you why.

You will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your personal information. In order to protect your personal information we may require identification from you before releasing the requested information.
If you would like to request access to, or correction of, any personal information we hold about you (and you are unable to access your GreenPepper Invest account to review or make the change), please contact us (details below).

An important note about children

Children (persons under the age of 18 years) are not eligible to use our services unsupervised and we ask that children do not submit any personal information to us. If you are under the age of 18 years, you can use this service only in conjunction with and under the supervision of your parents or guardians.

Changes to our Privacy Policy

We may update our Privacy Policy from time to time to reflect changes to law or our business practices. The updated Privacy Policy will be published on this website and will apply to all personal information held from that time onwards.
Where a change is significant we’ll send you an email and let you know.

We will treat your requests or complaints confidentially. All complaints received will be assessed and all reasonable steps (if any) will be taken to remedy the complaint. Our representative will endeavour to respond to your complaint within 30 days of receipt of the complaint by us.
